2. Scope and Target Group

  1. These General Terms and Conditions (GTC) apply to all contracts concluded between Groceteria (hereinafter referred to as “Provider”) and its customers (hereinafter referred to as “Customer”) via the online shop www.groceteria.eu.
  2. The offer on www.groceteria.eu is intended exclusively for consumers. The delivery of goods takes place only in normal household quantities.
  3. Individual agreements made with the customer in specific cases (e.g., additional agreements or amendments) take precedence over these GTC.

3. Conclusion of Contract

  1. The presentation of products in the online shop does not constitute a legally binding offer but a non-binding invitation for the customer to submit an offer.

  2. The contract is concluded when Groceteria accepts the customer’s offer by sending the ordered goods and confirming the dispatch via email. If certain products from an order are not included in the shipping confirmation, no purchase contract is concluded for those products.

4. Prices and Shipping Costs

  1. All prices are displayed in EUR and include applicable Value Added Tax (VAT).
  2. Shipping Costs:
    • Enjoy free shipping on orders over €49 with a maximum weight of 30KG. If your order exceeds 30KG, any additional shipments will be sent separately.
    • Orders below this amount are subject to a shipping fee of 5 EUR.

5. Delivery and Availability of Goods

    • Orders will be shipped within 2-5 working days unless otherwise stated.
    • We strive to fulfill every order precisely. However, if a specific brand of pulses or grains isn’t currently available, we’ll thoughtfully select a comparable, high-quality alternative to ensure your needs are met and we uphold our commitment to excellent service.
    • In the event of a product being out of stock due to supplier delays or errors, we’ll let you know and issue a refund immediately.
    • Groceteria does not assume the procurement risk for unavailable goods.

6. Shipping and Transfer of Risk

  1. Deliveries are made only within Germany.
  2. No shipments to parcel stations.
  3. Customers must provide an accurate delivery address.
  4. If delivery is made to a neighboring household, company, or parcel shop, the risk of loss or damage transfers to the customer.

 

7. Retention of Ownership

  • The delivered goods remain the property of Groceteria until full payment has been received.

    • Customers are always welcome to pick up their favorite products at our store.

9. Right of Withdrawal

  1. Perishable food items cannot be returned in accordance with § 312g Abs. 2 Nr. 2 BGB.
  2. Non-perishable items may be returned within 3 days if they are unopened and undamaged.
  3. The customer bears the cost of return shipping unless the product was defective or incorrect.

 

10. Payment

  1. Customers can choose from the following payment methods:
    • Credit Card
    • PayPal
    • Bank Transfer
  2. Payments are due immediately upon order confirmation.
  3. In case of late payments, interest of 5 percentage points above the base interest rate may be charged.

 

11. Warranty & Liability

  1. The statutory warranty applies.
  2. Groceteria is liable for damages only in cases of:
    • Personal injury (life, limb, health) caused by negligence
    • Intentional misconduct or gross negligence
    • Breach of an essential contractual obligation
  3. In all other cases, liability is excluded.

12. Dispute Resolution

  • The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr.
  • Groceteria does not participate in this dispute resolution procedure.

 

13. Governing Law

  • These GTC are governed by the laws of the Federal Republic of Germany.

The German version of these GTC takes legal precedence over any English translation.

 

14. Cancellation Policy

Right of Withdrawal
You have the right to withdraw from this contract within 3 days without giving any reason.

You may use the model withdrawal form provided below, though it is not mandatory.

Consequences of Withdrawal

  1. If you cancel this contract, we will refund all payments received, including standard delivery costs.
  2. Refunds will be processed within 14 days using the same payment method unless otherwise agreed.
  3. We may withhold the refund until the returned goods are received.
  4. The customer bears return shipping costs, unless the product was defective.
